SUSPENDED IMPOSITION OF SENTENCE

On or about the 17th day of October, 2017, an Indictment was filed in this Court charging Mallory Rose Jansen with Count 1-2: Possession of a Forged Instrument contrary to SDCL §22-39-38 (F6); and Count 3: Petty Theft – 2nd Degree contrary to SDCL §§22-30A-1 and 22-30A-17.3 (M2). The offense occurred on or about the 5th day of September, 2017, in Clay County, South Dakota.

On the 9th day of November, 2017, the Defendant was arraigned on said Indictment. The Defendant appeared in person. The Defendant pled not guilty to Count 1-2: Possession of a Forged Instrument contrary to SDCL §22-39-38 (F6); and Count 3: Petty Theft – 2nd Degree contrary to SDCL §§22-30A-1 and 22-30A-17.3 (M2).

On the 1st day of February, 2018 the Defendant appeared in person. The Defendant pled guilty to Count 1: Possession of a Forged Instrument contrary to SDCL §22-39-38 (F6). The State dismissed Count 2 and Count 3. The Defendant waived her right to a jury trial, her right to confrontation, and her right against self-incrimination. A presentence investigation was waived.

On the 15th day of February, 2018, at a sentence hearing before the Honorable Cheryle Gering, the Defendant appeared in person.

The Defendant having pled guilty to the crime of Count 1: Possession of a Forged Instrument contrary to SDCL §22-39-38 (F6); the Court ordered the following:

• Defendant be imprisoned in the Clay County Jail for a term of 50 days to be served as follows: , 10 days to be served beginning May 1, 2018, at 9:00 o’clock a.m.; 20 days to be served beginning June 1, 2018, at 9:00 o’clock a.m.; and 20 days to be served beginning January 1, 2019, at 9:00 o’clock a.m. Defendant’s Court Services officer may recommend to the court that any of these jail terms be waived, but unless the court signs a written order waiving any of these jail terms, each of the jail terms shall be served by Defendant;

• Defendant is subject to the rules of the Clay County jail, Defendant shall be entitled to work release, release for education, or release for chemical dependency treatment or aftercare, with Defendant to pay all costs of these releases;

• Defendant shall pay a fine of $250.00; court costs of $104.00; and transcript fees of $70.81; and restitution in the amount of $152.22;

• Defendant shall repay Clay County fo all of his court appointed attorneys’ fees with payment going directly to the Clay County Auditor’s Office, 211 W. Main Street, Vermillion, SD;

• The imposition of sentence is suspended upon terms and conditions.

On or about the 28th day of August, 2017, an Indictment was filed in this Court charging Patrick Sanders with Count 1: Grand Theft by Obtaining Services without Payment contrary to SDCL §§22-30A-8 and 22-30A17 (F6). The offense occurred on or about the 12th day of May, 2017 through the 22nd day of June, 2017, in Clay County, South Dakota.

On the 7th day of December, 2017, the Defendant was arraigned on said Indictment. The Defendant appeared in person. The Defendant pled not guilty to Count 1: Grand Theft by Obtaining Services without Payment contrary to SDCL §§22-30A-8 and 22-30A17 (F6).

On the 9th day of February, 2018 the Defendant appeared in person. The Defendant pled guilty to Count 1: Grand Theft by Obtaining Services without Payment contrary to SDCL §§22-30A-8 and 22-30A17 (F6). The Defendant waived his right to a jury trial, his right to confrontation, and his right against self-incrimination. Defendant waived his right to a 48-hour delay in sentencing.

On the 9th day of February, 2018, before the Honorable Cheryle Gering, the Defendant appeared in person.

The Defendant having pled guilty to the crime of Count 1: Grand Theft by Obtaining Services without Payment contrary to SDCL §§22-30A-8 and 22-30A17 (F6); the Court ordered the following:

• Defendant shall pay court costs of $104.00; and transcript fees of $60.10; and restitution in the amount of $1,414.56; Defendant shall pay $150.00 per pay period towards his fines, costs and restitution;

• Defendant shall repay Clay County for all of his court appointed attorneys’ fees with payment going directly to the Clay County Auditor’s Office, 211 W. Main Street, Vermillion, SD;

• The imposition of sentence is suspended upon terms and conditions.
